What Happens if You Are Arrested?

Being arrested can feel overwhelming and frightening, not only for you but also for your family and friends. It is important to try and remain calm. Arrests happen every day, and you are not alone in facing this situation.

Know Your Rights

1. The right to legal advice
Request a solicitor immediately. The police have arrested you because they suspect you of committing an offence. Even if mistakes are made, the process of building a case begins the moment you are arrested. Having a solicitor present ensures your rights are protected.

2. The right to inform someone of your arrest
In most cases, you can ask that a friend, family member, or another trusted person is notified of your detention. There are only very limited circumstances where this right may be delayed.

3. Protection under the Police and Criminal Evidence Act (PACE)
The police must follow strict Codes of Practice, designed to safeguard your legal rights and personal freedoms. These rules govern how interviews are conducted, how long you can be held, and how evidence is obtained.
