- Multiple Offences
- Custody Threshold Crossed
- Immediate Imprisonment Avoided
MC Solicitors acted for a client facing two sets of serious offences, one involving allegations in a domestic context, with further offending committed whilst on court bail.
The charges included:
- Four offences of assault occasioning actual bodily harm (ABH)
- Four offences of common assault
- Theft
- An allegation of criminal damage
The prosecution evidence was strong, and the client accepted responsibility at an early stage. The custody threshold had been crossed, with significant aggravating factors increasing the likelihood of immediate imprisonment.
Following comprehensive preparation and persuasive mitigation advanced by defence counsel, the Crown Court imposed an 18-month custodial sentence, suspended for two years.
The sentence also included rehabilitation activity days, alcohol abstinence monitoring, GPS monitoring and a financial penalty.
Securing suspension of the custodial sentence was a particularly favourable outcome given the seriousness of the offending and the commission of further offences whilst on court bail.
Every criminal case depends upon its individual facts. Previous case outcomes do not guarantee the outcome of another case.
