A licensed security guard of previous good character was investigated for an alleged offence of Section 20 Grievous Bodily Harm (GBH).
A conviction could have had serious consequences for the client’s Security Industry Authority (SIA) licence, DBS disclosures, employment and professional reputation, in addition to the possibility of imprisonment.
The client maintained that he had acted to protect himself and another person from aggressive males.
The defence advanced self-defence and defence of another at the earliest opportunity, explaining the perceived threat and the client’s belief that his actions were necessary and proportionate. A carefully considered prepared statement was drafted on behalf of the client.
MC Solicitors ensured these circumstances were fully addressed during the voluntary police interview, alongside the CCTV evidence and the nature of the injuries sustained.
The investigation concluded with No Further Action (NFA).
A highly favourable outcome in a serious violence investigation, safeguarding the client’s position as a licensed security professional and avoiding the potentially far-reaching consequences of prosecution.
Every criminal case depends upon its individual facts. Previous case outcomes do not guarantee the outcome of another case.
