- Complex Additional Needs
- Police Caution Not Understood
- Interview Prevented
MC Solicitors assisted a vulnerable young person with complex needs who had been arrested in connection with multiple criminal damage and assault allegations.
During the police station consultation, it became apparent that the young person was unable to understand the police caution or appreciate the implications of being questioned.
This raised serious concerns about their ability to participate effectively in a police interview.
Representations were made directly to the custody sergeant that an interview should not take place, given the young person’s inability to understand the caution and their particular vulnerabilities.
The defence prioritised the client’s legal rights and welfare, challenging the appropriateness of proceeding with formal questioning.
The police took No Further Action (NFA) without conducting an interview or bringing charges.
A particularly important outcome demonstrating how informed representation and appropriate safeguarding can protect vulnerable young people during criminal investigations.
Every criminal case depends upon its individual facts. Previous case outcomes do not guarantee the outcome of another case.
